Welcome to AIKart. These Terms of Service ("Terms") govern your access to and use of the AIKart marketplace, AI sandbox testing environments, and related services (collectively, the "Services"). By accessing or using our Services, you agree to these Terms.

1. AIKart Services and Platform Role

AIKart is a marketplace platform that connects users ("Buyers") with third-party creators, developers, and organizations ("Sellers") offering AI agents, applications, and integrations.

We provide the platform, messaging system, and sandbox infrastructure to help you discover and test these tools. However, AIKart does not independently verify the accuracy, reliability, or safety of the third-party AI agents listed on the platform.

2. User Accounts and Responsibilities

You must provide accurate information when creating an account via email or third-party OAuth providers (e.g., Google, GitHub, X). You are responsible for maintaining the security of your account credentials. You agree not to use the Services for any illegal or unauthorized purpose, including attempting to bypass security measures, exploiting vulnerabilities, or distributing malicious code.

3. AI-Generated Content and Disclaimers

The Services allow you to interact with AI models and agents. You acknowledge that:

  • AI-generated outputs may contain errors, inaccuracies, or hallucinations.
  • You are solely responsible for reviewing and verifying AI outputs before relying on them.
  • AI outputs should not be treated as professional, legal, medical, or financial advice.
  • AIKart disclaims all liability for decisions you make based on AI-generated content.

4. Third-Party Agents and Applications

Most AI agents and endpoints accessible through AIKart are developed, hosted, and maintained by third-party Sellers.

  • Independence: Third-party applications are independent of AIKart and may be subject to the Seller's own terms and privacy policies.
  • No Guarantee: AIKart does not control third-party APIs and does not guarantee their uptime, functionality, or continued availability.
  • Transactions: Any commercial arrangements, subscriptions, or payments for third-party tools are handled off-platform between you and the Seller. AIKart does not currently process payments or offer refunds for third-party services.

5. User Content and Sandbox Testing

When you use our sandbox environments (e.g., uploading a .sql database file for API Endpoint testing), you submit content to the platform.

  • Ownership: You retain ownership of your submitted files, prompts, and messages.
  • Rights: You represent that you have the necessary rights and permissions to upload this data.
  • Restrictions: You must not upload illegal, highly sensitive, malicious, or infringing content. Anything you submit to try an agent is passed to that agent's operator (the Seller or a third-party provider), and files you upload for a trial are stored in our cloud storage. AIKart assumes no liability for an operator's handling of your data.

6. Seller and Developer Terms

If you list an AI agent or application on AIKart:

  • You are responsible for the accuracy of your listing metadata.
  • You must possess the necessary rights to distribute your application.
  • You are responsible for securing your API endpoints and infrastructure.
  • You must not publish applications containing malicious code, malware, or designed to abuse platform rate limits.
  • AIKart reserves the right to remove, suspend, or delist your applications at our discretion, without notice, for any violation of these Terms.

7. Security and Acceptable Use

You agree not to:

  • Abuse platform infrastructure or circumvent rate limits.
  • Perform unauthorized security testing, penetration testing, or scraping of the Services.
  • Interfere with or disrupt the integrity or performance of the platform.

8. Suspension and Termination

AIKart reserves the right to suspend or terminate your access to the Services at any time, for any reason, including violation of these Terms. You may stop using the Services at any time.

9. Disclaimers and Limitation of Liability

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIKART AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR REVENUE ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.
